Dispute Management

No-one would ever want to become involved in a court case.  But people do.  Why?   Because there are times when you just can’t give in, when you just can’t let the other guy get away with it, when you just have to stand up for yourself.

Being involved in a business dispute doesn’t mean that you will inevitably have to undergo a court case.  Nor does it mean that you will need to spend a fortune and wait five years for it to be resolved. The way to handle business disputes is to manage them effectively.  That’s where we come in.

Controlled costs
The biggest complaint that most people have about litigation is that it is expensive and that the costs blow out.  Certainly, disputes can involve unforeseen costs as the resolution process develops.  The trick is to avoid that. We work hard to control costs by comprehensively understanding the case as early as possible and using that knowledge throughout the process rather than just at the last minute at the door of the court. In this way we believe we can control legal costs and endeavour to avoid the blow-out.

Fixed fees
Part of our process to control costs is to offer a fixed fee for some of our dispute management services.  We are continuing to develop a range of fixed-fee products, but please contact us if you have a business dispute and would like to explore the possibility of a fixed-fee service from us.

Managing the process
Our approach to dispute resolution and litigation is all about careful management; whether it’s commercially astute opinion on the prospects of legal or commercial success, exploration of the available legal and commercial options, or full information on progress, costs and timing – we manage the process for you from the start to completion.

More than litigation
We are acutely aware of the risks involved for clients in the litigation process, and early settlement options such as negotiation, mediation and arbitration are always our first consideration.  We work to understand the broader issues behind a dispute and don’t just jump onto the tramlines of litigation in order to justify a higher fee.  We think strategically to develop a favourable outcome for our client.

Value advantages
In a traditionally high-cost area of law we have a number of competitive advantages that we pass on to the client through fees which are valuable, not cheap. Value comes from great service and a favourable outcome at a reasonable price.
