Deed of release for commercial dispute
When there is a dispute with another business and before either of the parties went to their solicitors the parties sat down and worked out a solution. That solution must be properly recorded. Depending on the type of dispute and the terms of the solution, it is vital to set out in a written document very clearly what the terms are and any ancillary provisions that might need to be covered. Because most often parties are releasing each other from certain rights as a result of the negotiated agreement, the document is most often in the form of a ‘deed of release’.
It can be amazing how people who have reached agreement in discussions have very different views as to precisely what the agreement is. As a result a written deed of release provides certainty, clarity and of course the necessary evidence of precisely what was agreed.
